Every bully, thief, and abuser should pay attention to changes in Indiana law that expands the protections of the "Stand Your Ground" law for someone who uses deadly force to stop a crime.
The proposal, House Bill 1284, aims to protect law-abiding citizens who use force, to keep themselves or others safe, by shifting the civil burden of proof to the plaintiff to convince a judge why the person who used force against them did so unlawfully.
As I have always said, criminals have a choice, victim's don't. Criminals who sue their intended victims, are more likely than not, complaining about the "unfair outcome" when the intended victim gets the upper hand.
If the potential target is capable of defending himself, and turns the tables on the bad guy, then victims should not have to risk bankruptcy by having to defend the justified use of force in a civil lawsuit.
Indiana University law professor Dr. Jody Lynee Madeira testified against House Bill 1284, stating that, "the bill, as it stands now, references 'a felony,' and I think we want to make sure that we know this only applies to the commission of forcible felonies...that carry a risk of serious bodily harm."
The real world problem with this statement is that by the time one can assess a criminal's intent of "causing serious bodily harm" it will be too late to prevent serious bodily harm.
